1. Acceptance of Terms

By accessing or using the HOAcares platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including HOA administrators, board members, property managers, and community residents.

2. Description of Service

HOAcares provides a multi-tenant, cloud-based homeowner association management platform. Features include but are not limited to:

  • Community website and portal management
  • Dues billing, invoicing, and online payment processing
  • Maintenance request tracking and work order management
  • Document storage, announcements, and community communications
  • Event scheduling, voting, and directory management
  • Violation tracking and architectural review workflows

3. Account Terms

You are responsible for maintaining the security of your account and password. HOAcares cannot and will not be liable for any loss or damage resulting from your failure to comply with this obligation. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other accounts or systems
  • Harass, abuse, or threaten other users
  • Transmit spam, chain letters, or unsolicited communications
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

5. Payment Terms

Certain features of the Service require a paid subscription. By selecting a paid plan, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

6. Data Ownership

You retain all rights to the data you upload to the Service. By using the Service, you grant HOAcares a limited license to use, store, and process your data solely for the purpose of providing the Service. Upon account termination, you may request an export of your data within 30 days.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by circumstances beyond our reasonable control.

8. Termination

Either party may terminate this agreement at any time. You may cancel your account through the platform settings or by contacting support. We may suspend or terminate your access if you violate these terms, fail to pay fees, or engage in activity that threatens the security or integrity of the Service. Upon termination, your right to use the Service ceases immediately.

9. Limitation of Liability

To the maximum extent permitted by law, HOAcares shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless HOAcares, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the state or federal courts located in California.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on the platform and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
